The main legal framework is established in <strong>Royal Decree 110\/2015 of 20 February<\/strong> on <a href=\"https:\/\/www.miteco.gob.es\/es\/calidad-y-evaluacion-ambiental\/temas\/prevencion-y-gestion-residuos\/flujos\/domesticos\/fracciones\/pilas-y-acumuladores\/como-y-donde-se-recogen-2022.html\">waste electrical and electronic equipment<\/a> (WEEE, known in Spain as RAEE) and <strong>Royal Decree 106\/2008 of 1 February<\/strong> on batteries and accumulators and the environmental management of their waste.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who must register<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In Spain, registration is required for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Manufacturers placing electrical or electronic equipment or batteries on the Spanish market under their own brand.<\/li>\n\n\n\n<li>Importers of these products for sale in Spain. Actually, if you are not registred, you will not be able to import the goods. <\/li>\n\n\n\n<li>Distance sellers established outside Spain who sell to Spanish consumers.<\/li>\n\n\n\n<li>Repackagers or rebranders placing on the market products made by third parties under their own brand.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Note:<\/strong> platforms such as Amazon or eBay require a valid producer registration number before allowing the sale of batteries or electronic devices.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Batteries &amp; Electronics (EPR) registration in Spain<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Registration is carried out separately depending on the type of product, but in both cases it is managed <strong>through a SCRAP (collective extended producer responsibility system)<\/strong>, which then communicates the registration to the competent authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At<a href=\"https:\/\/vatgreentax.com\/en\/green-tax\/\"> VAT &amp; GREEN TAX<\/a> we coordinate all the paperwork and we carry out the registration process on your behalf.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registration of EEE producers (RAEE)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Regulated by Royal Decree 110\/2015, producers must join an authorised SCRAP for electrical and electronic equipment. The SCRAP will:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Collect the company\u2019s details and tax identification number.<\/li>\n\n\n\n<li>Identify the EEE categories to be marketed according to Annex III of Royal Decree 110\/2015.<\/li>\n\n\n\n<li>Submit quarterly returns before the SCRAP<\/li>\n\n\n\n<li>Submit the registration to the <strong>Integrated Industrial Register (RII)<\/strong> on behalf of the producer.<\/li>\n\n\n\n<li>Provide the official registration number. <\/li>\n\n\n\n<li>Appoint a Spanish entity to act as the representantive. <\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Registration of battery and accumulator producers<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Regulated by Royal Decree 106\/2008, producers must join an authorised SCRAP for batteries and accumulators. The SCRAP will:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Identify the type of batteries or accumulators placed on the market (portable, automotive, or industrial).<\/li>\n\n\n\n<li>Record the company\u2019s details, tax identification number, categories, and estimated quantities.<\/li>\n\n\n\n<li>Submit the registration to the <strong>Register of Battery and Accumulator Producers<\/strong> on behalf of the producer.<\/li>\n\n\n\n<li>Provide the official registration number to be used on all invoices and product documentation. <\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Recommendations and professional services<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The EPR process in Spain involves <strong>multiple legal obligations<\/strong> beyond simply obtaining a registration number.
