1. VAT registration in Italy

When is VAT registration required?

In Italy, any business (EU or non-EU) must register for VAT from the very first taxable transaction. Unlike other EU countries, there is no minimum turnover threshold. A single taxable operation is enough to trigger the obligation to register with the Agenzia delle Entrate (Italian Tax Agency).

What types of operations require registration?

The most common activities that trigger mandatory VAT registration in Italy include:

  • Selling goods in Italy when reverse charge does not apply (e.g. B2C sales).
  • Providing services in Italy, particularly related to real estate, events, or catering.
  • Importing goods into Italy (even if they’re shipped later to other EU countries).
  • Making intra-EU acquisitions from other member states.
  • Performing intra-EU deliveries from Italy to other EU countries.
  • Distance sales to Italian consumers above €35,000/year (unless the OSS scheme is used).

Who must register?

  • EU businesses: May register directly or appoint a fiscal representative in Italy.
  • Non-EU businesses: Must appoint a fiscal representative, who is jointly liable for tax obligations.

Without VAT registration, companies cannot legally invoice with Italian VAT, file periodic returns, or claim VAT refunds.

2. Italian VAT returns and payments: Ongoing Obligations

Once registered, your business must comply with regular VAT reporting obligations based on your Italian turnover.

Periodic VAT returns

Frequency depends on your annual turnover:

  • Monthly: If sales exceed €700,000 for goods or €400,000 for services.
  • Quarterly: If under those thresholds (with a 1% payment surcharge).

Returns are filed electronically via the “Liquidazioni Periodiche IVA” system, using the F24 form.

Annual VAT return

All registered companies must file the Modello IVA, summarizing the previous year’s operations.

  • Deadline: Between February 1 and April 30 of the following year — even if no transactions occurred.

Intrastat declarations

Required for reporting intra-EU supplies of goods and services. Filing frequency depends on transaction volume and thresholds set by the Italian tax authority.

3. Electronic invoicing (Sistema SdI)

Italy is a pioneer in mandatory e-invoicing for all types of transactions (B2B, B2C, B2G): All invoices must be in XML format and submitted via the Sistema di Interscambio (SdI).

4. Reclaiming italian VAT

Registered companies can reclaim VAT paid on business-related expenses (e.g. rent, logistics, trade fairs). Reclaim procedures vary depending on the amount:

  • Up to €30,000: No bank guarantee required, but a certified accountant must validate the return (visto di conformità).
  • Over €30,000: A bank guarantee from an Italian institution (or branch) is mandatory.

5. Penalties for non-compliance

Italy applies significant penalties for late or missing VAT filings:
