If your Spanish VAT number does not appear in VIES, your company may face immediate practical problems. EU suppliers may refuse to issue invoices without VAT, customers may question your VAT status, Amazon can reject your account and intra-EU transactions may be delayed.
In Spain, having a Spanish VAT number is not always enough. A proper Spanish VAT registration is necessary to be carried by experts. For many intra-Community transactions, the business must also be registered in the Spanish Register of Intra-Community Operators, known as VIES. Only then will the VAT number normally appear as valid in VIES.
At VAT & Green Tax, we assist Spanish and foreign businesses every week with Spanish VIES registration, including new applications, responses to requests from the Spanish Tax Authorities and rejected applications.
Why your Spanish VAT number does not appear in VIES.
There are several reasons why a Spanish VAT number may not appear as valid in VIES.
The most common reason is that the company has obtained a Spanish VAT number but has not been registered in the ROI. This is a separate census registration and must be specifically requested before the Spanish Tax Authorities.
Another frequent situation is that the application is still under review. The AEAT may ask for additional evidence before approving the registration.
In other cases, the application may have been rejected because the taxpayer did not properly justify the need to carry out intra-Community transactions.
Why Spanish VIES registration matters.
Spanish VIES registration is not a mere administrative formality. It has a direct impact on how a company operates with customers, marketplaces and suppliers.
For example, if a company purchases goods from a supplier established in another EU Member State, the supplier will normally want to verify the Spanish VAT number in VIES before issuing an invoice without local VAT.
If the Spanish VAT number does not appear in VIES, the supplier may charge VAT in its own country, block the order or request additional documentation.
This creates commercial friction, cash-flow issues and potential VAT recovery procedure in other EU countries.
Common reasons for rejected Spanish VIES applications.
The Spanish Tax Authorities do not always approve VIES registration automatically.
They may reject the application if the company does not provide enough evidence of real intra-Community activity or if the census position of the business is not properly aligned with the transactions described.
Common issues include:
- The company is not properly registered for its business activity.
- There is no clear evidence of planned EU purchases or sales.
- No Spanish VAT representantive has been appointed when it is mandatory.
- The taxpayer has outstanding tax debts or compliance issues.
- The supporting documentation is too generic or incomplete.
- The transactions described are not consistent with the company’s declared activity.
In practice, many rejections can be avoided by preparing the application correctly from the outset.
How to fix a Spanish VAT number not showing in VIES.
The first step is to identify whether the company has actually applied for ROI registration or whether it only has a Spanish VAT number/Local VAT.
If no application has been filed, the company should prepare and submit the corresponding census declaration, together with the appropriate supporting documentation.
If the application is pending, it is important to respond properly to any request from the AEAT. The response should clearly explain the business model, the expected intra-Community transactions and the commercial need for VIES registration.
If the application has been rejected, the company should review the reason for the rejection and assess whether it is better to submit additional arguments, appeal the decision or file a new application with stronger evidence.
We also at VAT & GREEN TAX arange a meeting with the VIES tax officers in order to speed up the procedure and to know what it is the issues.
Documentation that may support a Spanish VIES application
The documentation depends on the business model, but the Spanish Tax Authorities usually expect evidence that the company genuinely intends to carry out intra-Community transactions.
This may include contracts, purchase orders, pro forma invoices, commercial correspondence with EU suppliers or customers, logistics documentation, 3PL agreement, lease agreements, proof of business premises or other documents showing real economic activity.
The key point is that the file should tell a coherent story: who the company is, what it sells or buys, why it needs VIES registration and how the intra-Community transactions will be carried out.
